The ground rules for using CAIN’s services.
These terms cover cainetwork.ca, the member directory and portal, our research publications, and sign-ups for CAIN programs. Like our Privacy Policy, they are written to be read.
These terms govern your use of cainetwork.ca and the services we offer through it — the public member directory, the member portal, our research publications, and sign-ups for CAIN programs and pilots (together, the “services”). The services are operated by the Canadian Accelerator and Incubator Network Association (“CAIN”), a registered not-for-profit association (registration no. S0073437). By using the services, you agree to these terms.
How we handle personal information is described in our Privacy Policy, which forms part of these terms.
CAIN membership is free and open to Canadian accelerators, incubators, and ecosystem organizations. When you create an account or sign in, you agree to provide accurate information, keep your sign-in credentials secure, and let us know promptly at hello@cainetwork.ca if you believe your account has been used without your authorization. You are responsible for activity under your account.
We may suspend or close an account that violates these terms or poses a security risk. You can stop using the services at any time, and can ask us to close your account by emailing us.
When using the services, you agree not to:
- break the law, or misrepresent yourself or your affiliation with an organization;
- access, scrape, or bulk-extract the member directory, our research dataset, or other site content by automated means, or resell or redistribute our data, without our written permission;
- use our data to train or fine-tune AI or machine-learning models without our written permission;
- use the member directory or our research dataset to build a competing directory, CRM, or network service without our written consent;
- interfere with the operation or security of the services, probe for vulnerabilities, or attempt to access accounts or data that are not yours;
- submit content that is unlawful, misleading, infringes someone else’s rights, or contains malicious code.
You keep ownership of what you submit through the services — directory updates, portal posts, program applications, and similar content. By submitting it, you confirm you have the right to share it and that it is accurate to the best of your knowledge, and you grant CAIN a non-exclusive licence to host, display, and use it to operate the services — for example, publishing your organization’s directory profile.
We review directory submissions before publishing and may edit for formatting, decline, or remove content that does not meet these terms or our editorial standards.
The services, including our research publications, the member directory, and our research dataset, are owned by CAIN or its licensors and protected by intellectual property law. You may use them for your own organization’s purposes, and you may share our public reports with attribution to CAIN. Bulk extraction, republication of substantial portions, or commercial resale of our content or data requires our written permission.
Some CAIN offerings — such as member access to Startup Tracker data services — are provided under separate agreements, which govern those offerings where they differ from these terms. The services also link to and integrate with third-party services (for example, signing in with Google or LinkedIn); your use of those services is governed by their own terms.
The services are provided on an “as is” and “as available” basis. Our research dataset and publications are compiled from public and commercial sources and, while we work to keep them accurate, we do not warrant that they are complete, current, or error-free. They are provided for information purposes and are not professional, legal, financial, or investment advice. To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Some of our services include AI-assisted features. Content generated by AI can be incomplete, inaccurate, or misleading even when it appears authoritative — review it before relying on it in operational, financial, legal, or policy decisions.
To the maximum extent permitted by applicable law, CAIN will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the services. CAIN’s total liability for claims relating to the services is limited to the amounts you paid CAIN for the service giving rise to the claim in the twelve months before the claim arose. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
We may suspend or terminate access to the services, or any feature of them, where these terms are violated, where required for security or legal reasons, or where we retire a feature. Sections of these terms that by their nature should survive termination — including sections 5, 7, 8, and 11 — survive it.
When we change these terms, we will post the new version here and update the effective date above. If a change meaningfully affects your rights or obligations, we will flag it prominently on this page. Continuing to use the services after a change takes effect means you accept the updated terms.
These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Disputes relating to these terms or the services will be resolved in the courts of British Columbia, and you and CAIN each attorn to their jurisdiction.
